These terms govern use of the website wattrate.eu, the API at api.wattrate.eu and the WattRate iOS and Android apps (together: the “Service”). By using the Service you accept these terms.

1. General

  1. The Service is operated by MTBIZ Marcin Tymków (the “Provider”) and is used to search and compare EV charging stations in Poland and the European Union, including prices, occupancy and technical parameters.
  2. These terms are published free of charge and bind all users.
  3. Polish law applies to matters not covered here, including consumer law where applicable and the Civil Code.

3. Scope

  1. The Service is informational. The Provider is not a charge-point operator and does not intermediate energy payments.
  2. Station data come from AFIR National Access Points (including EIPA/UDT in Poland, NDW in the Netherlands, MobiData BW in Germany, IRVE in France, E-Control in Austria, and — once credentials are granted — NDIC and NAP AFIR SR) and from public operator tariffs. The Provider takes care to keep data current but does not guarantee completeness or accuracy of external sources.
  3. Prices are indicative. The final rate depends on the operator, tariff, time of day and payment method. Verify conditions with the operator before charging.
  4. Occupancy data come from NAP dynamic feeds and may be delayed; stale statuses are treated as unknown.

4. Acceptable use

  1. Basic features are free and do not require an account.
  2. Mass harvesting of the API without consent, bypassing technical protections, overloading infrastructure and infringing third-party rights are forbidden.
  3. The Provider may apply API rate limits.
  4. The app may request location solely to find nearby stations.

5. Premium subscription

  1. Premium is an auto-renewing subscription purchased in the Apple App Store or Google Play. Prices and billing period are shown in the store before purchase.
  2. Apple or Google process payments. The Provider does not store card data.
  3. The subscription renews unless cancelled in the store at least 24 hours before the period ends. Refunds and withdrawal follow Apple, Google and consumer law.

6. Advertising

Ads may appear in the future after required consents (Apple ATT, Google UMP). See the Privacy policy.

7. Copyright and licence

  1. Software, layout and the “WattRate” name are protected. Copying without consent is forbidden except for personal use while using the Service.
  2. Maps may use OpenStreetMap and other open sources under their licences.
  3. NAP data are public under AFIR. Aggregating them does not transfer registry rights to the Provider.

8. Liability

  1. The Service is provided “as is”. The Provider is not liable for user decisions based on Service information.
  2. The Provider is not liable for outages caused by technical issues, maintenance, supplier failures or force majeure, except where mandatory law provides otherwise.
  3. Towards consumers, liability is limited to actual loss, subject to mandatory law.

9. Complaints and contact

  1. Complaints: hello@wattrate.eu. Response within 14 business days.
  2. Premium payment complaints should go primarily to Apple or Google.
  3. EU ODR: ec.europa.eu/consumers/odr.

10. Changes

The Provider may change these terms for valid reasons. Material changes will be announced at least 14 days in advance. Continued use means acceptance unless the law requires explicit consent.

11. Final provisions

  1. Access may be limited if these terms are breached.
  2. Polish law applies. Courts have jurisdiction under generally applicable rules; mandatory consumer venue rules are preserved.
  3. Personal data: Privacy policy.
